Information about us and these Terms

In these Terms:

"Product(s)" means various items of merchandise exclusively under the Figma brand;

"we", "us" or "our" means Figma Inc., a company registered in Delaware, United States of America with its principal place of business located at the address specified in section 3 below. Our US EIN/TIN is: 46-2843087. We are the owner and operator of the Website and the seller of the Products on the Website; and 

"you" or "your" means the person using our Website to buy Products from us.

Information that we provide to our customers

By law, we must give you certain key information before a legally binding contract between you and us is made. We will always give you this information in a clear and understandable way. This information is provided to you in these Terms. The key information we give you by law forms part of the contract between us.

Acceptance of these Terms

By making a purchase of one or more Products from us via the Website, you confirm that you: (a) accept these Terms; (b) agree to comply with these Terms; and (c) that you are legally bound by these Terms. 

We can make changes to these Terms at any time and without prior notice. However, the Terms which apply to your Order (defined below in section 9.2) will be the version of these Terms published on the Website at the time you submitted your Order.  

These Terms are published in English only. A copy will be supplied via e-mail with each Order Confirmation (defined below in section 10.3). However, we recommend that you print or save a copy of these Terms for future reference.

These Terms refer to the following additional terms, which also apply to your use of our Website and information that you provide to us when making a purchase:

Your personal information

Your privacy and personal information are important to us. Any personal information that you provide to us will be dealt with in line with our Privacy Policy which explains what personal information we collect from you, how and why we collect, store, use and share such information, your rights in relation to your personal information and how to contact us and supervisory authorities if you have a query or complaint about the use of your personal information.

Our Products

Descriptions of our Products are set out on the Website. Please read the descriptions carefully. Pictures and images of the Products and their packaging are for illustration purposes only. Your Products and their packaging may vary slightly from those pictures or images. In case of a difference between the image and the written product specifications, the latter will always prevail.

We cannot guarantee that the colours displayed on your device will match exactly the appearance of your Products. The colours of the Products displayed on the Website may vary depending on what device you are using and your settings.

All weights, sizes and measurements set out on our Website are as accurate as possible.

You must use our Products only for domestic and personal use. You must not use our Products for a commercial, business or resale purpose.

Placing orders

Our Website has specific pages for customers in:

Canada;

The United States of America; and

Japan,

 (each a "Country Website")

To buy the Products from the Website, you must visit your Country Website and complete the order process: 

choose and add your selected Product(s) to the “Cart” and if you are happy with the contents of your "Cart", click on the "CHECKOUT" button; 

select an express checkout option via ShopPay, PayPal or Google Pay or provide your personal contact and shipping information and click on the "Continue to Shipping" button;

check the delivery charges under “Shipping method” and click on the "Continue to Payment" button

your order summary, contact and shipping information, shipping charges and taxes (if applicable) will be presented to you before you complete your purchase ("Order Summary"). Please check your information and Order Summary carefully and correct any errors prior to submitting your order; 

confirm your preferred method of payment, insert your payment information and click on the “Pay Now” button. At this stage, you can also add any gift card or discount code details in the box marked "Gift card or discount code" and click on the "Apply" button. The system will automatically change the total order amount, deducting any discounts or allowances. See section 12 below for more information on payment options. The exact process for placing an order may vary depending on the payment method selected;

to submit your order, you must tick the box confirming your acceptance of these Terms,

          ("Order").      

Should you need to change your Order or certain data contained within it, you will need to email us at thefigmastore@figma.com and we will let you know if it is possible to change your Order. 

Your contract with us

The publication of Products on the Website constitutes an invitation to you to make an offer of purchase. You offer to buy the Products from us when you place an Order with us. When you place an Order with us, you also indicate your complete awareness and acceptance of these Terms.

After you place your Order, we will send you an acknowledgement email to say that we have received your Order. This acknowledgement does not, however, mean that your Order has been accepted by us.

Acceptance of your Order takes place when we dispatch your Order to you, at which point a legally binding contract will be in place between you and us (“Order Confirmation”). 

The Order Confirmation will give you an "Order Number," to be used in all subsequent communications with us. It will include the information supplied to us by you and the information required by law and you agree to check its accuracy and immediately let us know of any corrections. Any extra costs incurred due to incorrect information which was not promptly reported will be your exclusive responsibility. Your Order Confirmation will also contain your shipment's tracking information to allow you to keep tabs on the progress of your delivery.

We will contact you by email to tell you if we do not accept all or part of your Order. This is typically for the following reasons (this is not an exhaustive list): the Products are unavailable; you are under the age of eighteen (18); we cannot ship to you; we cannot authorise your payment; you are not allowed to buy the Products from us; we are not allowed to sell the Products to you; you have ordered too many Products; or there has been a mistake on the pricing or description of the Products. We have the right to reject any Order for any reason, without any liability to you.

All Orders are subject to availability. We cannot guarantee that any Product will be available at any given time. In certain circumstances beyond our reasonable control, for example where there has been a change in law, we may need to stop selling certain Products.

If we do not accept your whole Order, your Order will be cancelled. If payment has already been processed, we will provide you with a full refund (including any delivery costs) using the same means of payment as you used for the initial transaction.

If we do not accept part of your Order, such part of your Order will be cancelled. If payment has already been processed, we will provide you with a refund to the value of those cancelled Products using the same means of payment as you used for the initial transaction. Any Products forming part of the same Order which are still available will be sent to you and charged for as normal.

In particular, we reserve the right to not accept Orders and cancel orders that do not give adequate assurance of solvency or if – even after checking with the network that manages credit card payments – anomalies are found in the transactions and in the payment methods used by you.

Product pricing

All Product prices are clearly indicated on the Website. On each Country Website, the prices are  indicated in the local currency: The United Kingdom (GBP sterling (£)); the European Union (Euros(€))); Canada (Canadian Dollars); the United States of America (US Dollars); and Japan (Japanese Yen).

United States Country Website: the prices are stated in United States Dollars (USD$) and include VAT at the applicable rate, but exclude delivery charges. Shipping expenses are displayed at the time of the Order. The cost for each shipment may vary, depending on the shipping and payment methods as well as on the final destination and total order amount.

Canada Country Website: the prices are stated in Canadian Dollars (CAD$) and include VAT at the applicable rate, but exclude delivery charges. Shipping expenses are displayed at the time of the Order. The cost for each shipment may vary, depending on the shipping and payment methods as well as on the final destination and total order amount.

UK Country Website: the prices are stated in GBP sterling (£) and include VAT at the applicable rate, but exclude delivery charges. Shipping expenses are displayed at the time of the Order. The cost for each shipment may vary, depending on the shipping and payment methods as well as on the final destination and total order amount.     

EU Country Website: the prices are stated in Euros (€) and include VAT at the applicable rate, but exclude delivery charges. Shipping expenses are displayed at the time of the Order. The cost for each shipment may vary, depending on the shipping and payment methods as well as on the final destination and total order amount.

Japan Country Website: the prices are stated in Japanese Yen (¥) and include VAT at the applicable rate, but exclude delivery charges. Shipping expenses are displayed at the time of the Order. The cost for each shipment may vary, depending on the shipping and payment methods as well as on the final destination and total order amount.

Depending on your location, your Order will be shipped from the United Kingdom, Ireland, or the United States. You will not need to pay customs on your Orders.

United Kingdom: Orders from customers in the United Kingdom will be shipped from the United Kingdom.     

European Union: Orders from customers in the European Union will be shipped from Ireland.

Japan: Orders from customers in Japan will be shipped from the United States.

United States: Orders from customers in the United States will be shipped from the United States.

Canada: Orders from customers in Canada will be shipped from the United States.

Prices for our Products and delivery charges may change at any time. Except as set out in sections 11.14 and 11.15 below, such changes will not affect your Order.

If there has been an error on the Website regarding the pricing of any of our Products and this affects your Order, we will try to contact you using the contact details that you provided when placing your Order. We will give you the option to re-confirm your Order at the correct price or to cancel your Order. If we are unable to contact you, we will cancel your Order and notify you by email.

If the rate of VAT (or other applicable sales tax) changes between your Order date and the date we dispatch the Products, we adjust the rate of VAT (or other applicable sales tax) that you pay, unless you have already paid in full before the change in the rate of VAT (or other applicable sales tax)  takes effect.

11.16 Discount codes can be used together with other commercial initiatives only where the possibility to do so is explicitly indicated.     

Invoicing and payment terms

Your Order Confirmation will act as an invoice for your Order. When issuing the invoice, we rely on the information provided by you. Once the invoice is issued it will not be possible to make any changes to this information.

United Kingdom: You can only pay for Products using a credit card, PayPal, ShopPay or when available, a Gift Card. We accept the following cards: VISA, Master Card, American Express, Discover, PayPal, ShopPay and Google Pay.

European Union: You can only pay for Products using a credit card, Google Pay or ShopPay or, when available, a Gift Card. We accept the following cards: VISA, Master Card, American Express, Discover, ShopPay and Google Pay.

Japan: You can only pay for Products using a credit card, PayPal, ShopPay or when available, a Gift Card. We accept the following cards: VISA, Master Card, American Express, Discover, PayPal, ShopPay and Google Pay.

United States: You can only pay for Products using a credit card, ShopPay, Google Pay or when available, a Gift Card. We accept the following cards: VISA, Master Card, American Express, Discover, ShopPay and Google Pay.

Canada: You can only pay for Products using a credit card, ShopPay Google Pay or when available, a Gift Card. We accept the following cards: VISA, Master Card, American Express, Discover, ShopPay and Google Pay.

We use Shopify to host our Website. Shopify is PCI-DSS compliant. Authority for payment must be given at the time the Order is made. By clicking “PAY NOW” you are confirming that the credit card is yours. The amount authorised by you will not be taken until your Order is dispatched for delivery. If payment is made via PayPal, ShopPay or Google Pay, the amount will be charged when you submit your Order. All payments by credit card or debit card need to be authorised by the relevant card issuer and we may also need to use extra verification or security steps.

    Shipping methods and charges

We agree to ship Products within an estimated ten (10) business days of an Order Confirmation and to deliver the Products without undue delay. During peak periods, processing times may be longer. 

We will provide you with an estimated delivery timeframe with your Order Confirmation. Products are delivered by way of courier, and delivery times vary depending on the place of destination. In any event, the delivery dates indicated at the time the Order is placed are approximate.

We will not be liable in any way to you for any delays in fulfilling the Order or in delivering the Products listed in the Order Confirmation due to circumstances beyond our reasonable control. 

The Products in the Order Confirmation will be sent to the mailing address specified by you. Once we have turned over the Products to the courier, you will receive an e-mail confirming the shipment.

Deliveries are made from Monday to Friday, during normal business hours, except on national holidays, according to the terms and conditions set forth by the courier. Delivery will take place when we deliver the Products to the address you gave us in the Order.  If we cannot deliver the Products to you within thirty (30) days, we will let you know by email, cancel your Order, and give you a refund, net of the costs incurred to return the Products and of expenses for their storage at the facilities of the courier in charge of their delivery.

Termination of your contract with us and the amount of the refund will be notified via e-mail. The refund amount will be credited on the payment method used by you for the purchase. 

At the time of delivery of the Products by the courier hired by us, you should carefully check:

the packaging has not been damaged or otherwise altered; and

that the number of delivered pieces matches the amount indicated in the shipping document.

You must immediately report any damage to the packaging or to the Products or if the number of units/packages or indications do not match, by contacting us at thefigmastore@figma.com, indicating the Order for which these problems occurred.

You are responsible for the Products when delivery has taken place. In other words, the risk in the Products passes to you when you take possession of the Products.

Events outside the reasonable control of the parties, including but not limited to unavailability of means of transportation and unforeseen or unavoidable events (e.g., natural disasters, extreme weather, industrial action) that result in a delay in deliveries or make deliveries difficult or impossible or cause significant increases in our delivery expenses, will give us the right to split up, resend or cancel the Order, in full or in part, or to cancel your contract with us. In these cases, we will inform you of our decision by sending an e-mail to the address provided by you, and you will only be entitled to a refund of any sums already paid, excluding any other claims against us for any reason.

Your legal right to change your mind

You have the legal right to change your mind about your purchase without giving any reason and receive a refund of what you paid for it, including the delivery costs. This is subject to some conditions, as set out below. 

Deadline for changing your mind: You must let us know no later than fourteen (14) days after the day we deliver your Products (which is the day on which you or a third party named by you, who is not the courier, has taken physical possession of the last item in the Order. If the Products are split into several deliveries over different days, the period runs from the day after the last delivery). You can send your communication exercising your right to cancel at any time before the fourteen (14) day cancellation period has expired.

How to cancel: To exercise the right to cancel, you must inform us of your decision to cancel by a clear statement (e.g. a letter sent by post to the address in section 3 above or an e-mail to thefigmastore@figma.com).  You may use the model cancellation form in the Appendix to these Terms, but this is not obligatory.

Effects of cancellation: If you cancel this contract in accordance with the provisions of this section 14, we will provide you a refund of all payments received including the cost of delivery, without undue delay and in any event no later than fourteen (14) days after our receipt of your request to cancel. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless otherwise agreed in written correspondence between us and you. We don't charge a fee for the refund. We do not require you to return the applicable Products which are the subject of the refund to us. 

For purposes of clarity, we only provide the cancellation and refund rights above. We cannot facilitate edits to an Order once placed.

Product non-compliance and defective products

Products offered on the Website comply with applicable legislation currently in force. We honour our legal duty to provide you with Products that are as described on our Website and that meet the requirements imposed by law. 

As a consumer, you have legal rights in relation to the Products and nothing in these Terms shall affect your legal rights. Your legal rights are summarised in section 15.3 below. These are subject to certain exceptions.  

A summary of your key legal rights in respect of Products purchased from us is as follows:

goods must be as described, fit for purpose and of satisfactory quality; and 

during the expected lifespan of your product your legal rights entitle you to the following:


Up to thirty (30) days:

If your Product is faulty, you can get an immediate refund.

Up to six (6) months:

If a faulty product cannot be repaired or replaced, then you are entitled to a full refund in most cases.

Up to six (6) years:

If the Product does not last a reasonable length of time and you can show the fault was present at the time of purchase, you may be entitled to some money back.

If your Product is faulty or mis-described, please contact us as soon as possible by email at thefigmastore@figma.com. A communication from our staff will follow, indicating the refund methods available, which you can select from at your discretion.

    Proceeds to charity     

     Any and all profits we generate from the Website will be used to purchase carbon removal credits via reforestation from TIST (The International Small Group and Tree Planting Program). TIST is an innovative time-tested reforestation program that supports subsistence farmers in Kenya, Uganda, and Tanzania to tackle sustainable development and climate change through education and tree planting.

    End of the contract

If the contract between us is ended it will not affect our right to receive any money which you owe to us under these Terms.

Our responsibility to you

If we breach these Terms or are negligent, we are liable to you for foreseeable loss or damage that you may suffer as a result. By 'foreseeable', we mean that, at the time the contract was made, it was either clear that such loss or damage would occur, or you and we both knew that it might reasonably occur, as a result of something we did (or failed to do).

We are not liable to you for any loss or damage that was not foreseeable, any loss or damage not caused by our breach or negligence, or any business loss or damage.

Nothing in these Terms excludes or limits our liability for any death or personal injury caused by our negligence, liability for fraud or fraudulent misrepresentation, or any other liability that the law does not allow us to exclude or limit. 

Transfer of rights

We may transfer our rights and obligations under our contract with you to another organisation, but this will not affect your rights or our obligations under these Terms. We will always notify you by posting on our site if this happens.

You are not allowed to transfer your rights or obligations under these Terms to anyone without our prior written consent.

Other important terms

No one other than us or you has any right to enforce any of these Terms. 

If a court invalidates some of this contract, the rest of it will still apply. If a court or other authority decides that some of these Terms are unlawful, the rest will continue to apply.

Any notice under these Terms must be given in writing. The parties agree to receive all communications, agreements, and notices under these Terms (“Communications”) electronically, including by e-mail or by posting on the Website. The parties agree that notices delivered electronically satisfy any legal requirement that such Communications be in writing. You further agree that we are not responsible for your failure to receive notices if you fail to provide accurate and up to date personal contact information.  Communications will be deemed given on the day sent.

Applicable law and place of jurisdiction

If you are purchasing Products from the United Kingdom:

These Terms as well as any other contract entered into with you are governed by English law.

Any controversy arising from or relating to the interpretation, execution, validity or efficacy of these Terms and of any other contract entered into with you will be submitted to the exclusive jurisdiction of the English courts.     

If you are purchasing Products from the European Union: 

These Terms as well as any other contract entered into with you are governed by the laws of Ireland.

Any controversy arising from or relating to the interpretation, execution, validity or efficacy of these Terms and of any other contract entered into with you will be submitted to the exclusive jurisdiction of the courts located in Dublin, Republic of Ireland.

If you are purchasing Products from the United States or Canada: 

These Terms as well as any other contract entered into with you are governed by the laws of California.

Any controversy arising from or relating to the interpretation, execution, validity or efficacy of these Terms and of any other contract entered into with you will be submitted to the exclusive jurisdiction of the federal and state courts located in San Francisco, California.

If you are purchasing Products from Japan: 

These Terms as well as any other contract entered into with you are governed by the laws of Japan.

Any controversy arising from or relating to the interpretation, execution, validity or efficacy of these Terms and of any other contract entered into with you will be submitted to the exclusive jurisdiction of the Japanese courts.
